This Liability Release Waiver (“Waiver”) is given by the Participant identified herein, or if the Participant is under the age of 18 years, then also by the Participant’s parent or legal guardian (collectively “Participant”) in favor of and for the sole benefit of the Released Parties. In connection with Participant’s involvement in any and all training, instruction, competing, playing or attending activities with RRQB Training LLC, including, without limitation, any tournament, game, match, practice, camp, clinic, showcase, rehabilitation, therapy, or any other activity or event at the Sports Complex (collectively “Event”), Participant warrants, represents, agrees and covenants to RRQB Training LLC and all of its officers, employees, contractors, trainers, staff, officials, Guests and other participants (the “Released Parties”), that Participant is, and will be, during any Event or while in the Sports Complex:

(1) free of any mental or physical condition, ailment or injury (medical or otherwise) which would, in and of itself or in conjunction with any other circumstance, including but not limited to those activities associated with Events, (i) impair or place Participant at risk for engaging in Event activities or (ii) be affected, aggravated or worsen in any way as a result, directly or indirectly, Participant’s involvement in such Event; and

(2) of sound mind and body, and not under the influence of alcohol or any illicit or prescription drug or medication which may impair Participant’s ability to enter into this Waiver or participate in the Event.

ASSUMPTION OF RISK. PARTICIPANT AGREES THAT PARTICIPANT DERIVES OR WILL DERIVE A MATERIAL BENEFIT FROM PARTICIPANT’S INVOLVEMENT IN EVENTS. PARTICIPANT ACKNOWLEDGES THAT EVENTS MAY INVOLVE STRENUOUS ACIVITY, PHYSICAL CONTACT, AND MOVEMENTS WHICH MAY BE POTENTIALLY HAZARDOUS OR CAUSE INJURY TO PARTICIPANT OR OTHES. PARTICIPANT ASSUMES ALL RISKS ASSOCIATED WITH PARTICIPATING IN THE EVENT, INCLUDING, WITHOUT LIMITATION, FALLS, CONTACT WITH OTHER PARTICIPANTS AND/OR EQUIPMENT, WHICH MAY RESULT IN, WITHOUT LIMITATION, OVEREXERSION, ABRASIONS, BROKEN BONES, STRAINED OR TORN MUSCLES OR LIGAMENTS, AND SERIOUS INJURY TO THE BODY OR PERSON, INCLUDING EFFECTS OF WEATHER AND THE CONDITION OF SURFACES. PARTICIPANT EXPRESSLY AND UNCONDITIONALLY ASSUMES ALL RISKS AND DANGERS RELATING TO OR INCIDENTAL TO PARTICIPANT’S INVOLVEMENT IN THE EVENT AND ANY ACTIVITY ASSOCIATED THEREWITH. PARTICIPANT HEREBY RELEASES, FOREVER DISCHARGES AND HOLDS HARMLESS THE RELEASED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS AND EXPENSES, INCLUDING, BUT NOT LIMITED TO, DEATH, BODILY INJURY OR PROPERTY DAMAGE OF ANY KIND OR NATURE (COLLECTIVELY, THE “LOSSES”), ARISING OUT OF OR RELATING TO PARTICIPANT’S INVOLVEMENT IN THE EVENT AND ALL ACTIVITIES ASSOCIATED THEREWITH, INCLUDING LOSSES CAUSED BY THE NEGLIGENCE, OR ALLEGED NEGLIGENCE, OF THE RELEASED PARTIES.

PARTICIPANT’S INSURANCE. Participant represents to each Released Party that Participant is covered by Participant’s health insurance for injury caused, in whole or in part, by Participant’s involvement in Events.

MEDICAL ATTENTION CONSENT. Participant authorizes Released Parties to secure appropriate medical attention for Participant in the event of an accident, illness or injury while at the Sports Complex. Participant shall be responsible for any and all costs of medical treatment, emergency personnel, medical supplies, and emergency transportation provided by the Released Parties, and not covered by Participant’s insurance.

NAME, IMAGE & LIKENESS RELEASE. Participant agrees that the Released Parties shall have the right tape, photograph and edit Participant, including recording Participant’s voice, conversation and sounds, including any performance of any musical composition(s), during and in connection with Participant’s activity/performance in public spaces within the Sports Complex and that Released Parties shall be the exclusive owner of the results and proceeds of such taping, photography, recording and editing with the right, throughout the world, an unlimited number of times in perpetuity, to copyright, to use and to license others to use, in any manner, all or any portion thereof or of a reproduction thereof in connection with Participant’s activity/performance or otherwise. For purposes of clarity, Participant expressly waives any and all moral rights Participant may have in connection with Participant’s appearance.

Participant further agrees that Released Parties may use and license others to use Participant’s name, voice, likeness and any biographical material concerning Participant that Participant may provide, in the promotion, advertising, sale, publicizing and exploitation of Participant’s activity/performance and/or otherwise, including without limitation ancillary products (e.g., merchandise) throughout the world in all media, now known or hereafter devised, an unlimited number of times in perpetuity. Participant further represents that any statements made by Participant during Participant’s appearance are true, to the best of Participant’s knowledge, and that neither they nor Participant’s appearance will violate or infringe upon the rights of any third party.

Participant hereby waives any right of inspection or approval of Participant’s appearance or the uses to which such appearance may be put. Participant also hereby waives any right Participant may have to seek injunctive relief in connection with Released Parties exercise of the rights granted hereunder. Participant acknowledges that Released Parties will rely on this permission potentially, at substantial cost to Released Parties and hereby agree not to assert any claim of any nature whatsoever against anyone relating to the exercise of the permissions granted hereunder.

GOVERNING LAW/JURY WAIVER: Texas law governs this Waiver. PARTICIPANT KNOWINGLY AND INTENTIONALLY WAIVES THE RIGHT TO A JURY TRIAL AS TO ANY INCIDENT, ACCIDENT, OR CLAIM ARISING OUT OF PARTICIPANT’S INVOLVEMENT IN AN EVENT OR WHILE AT THE SPORTS COMPLEX. THE WAIVER AND RELEASE GRANTED BY PARTICIPANT HEREUNDER IS LEGALLY BINDING AND SHALL BE CONSIDERED IRREVOCABLE. PARTICIPANT AGREES THAT ALL RELEASED PARTIES MAY AND WILL RELY UPON THIS AGREEMENT TO THE FULLEST EXTENT PERMISSIBLE AT LAW OR IN EQUITY.

Participant understands that by signing this Waiver, Participant covenants and agrees that Participant, as well as Participant's heirs, executors, and administrators, cannot file or maintain a lawsuit against any of the Released Parties for damages, costs, loss, expenses or compensation for or on account of any damage, loss or injury either to Participant's person or property, or both, which may result from the Participant's participation in the Event or at Sports Complex.

Participant is consenting to the use of Participant's electronic signature in lieu of an original signature on paper. Participant has the right to request that Participant sign a paper copy instead, but is waiving that right with Participant's electronic signature. After consent, Participant may, upon written request to Manager of Sports Complex, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with Sports Complex for any documents will continue until such time as Participant notifies Sports Complex Manager in writing that Participant no longer wishes to use an electronic signature. There is no penalty for withdrawing Participant's consent. Participant should always make sure that Sports Complex has a current email address in order to contact Participant regarding any changes, if necessary. The submit button selection certifies that he/she is the parent or legal guardian of the Participant, and has full legal power and authority to sign this Waiver on behalf of the Participant.
